Claims against Oregon government bodies follow special rules that can defeat your case before it starts.
The Notice Requirement
Before suing a public body, you must provide 180 days to file a formal tort claim notice against a public body under the Oregon Tort Claims Act (ORS 30.275). The notice must identify the time, place, and circumstances of the injury. Missing it usually bars the claim entirely.
Who Counts as a Public Body
Cities, counties, the State of Oregon, school districts, transit agencies like TriMet, public universities, and their employees acting within the scope of their duties all fall under the Act.
Damage Limits
The Act caps the liability of public bodies at amounts set by statute and adjusted over time. These limits differ from ordinary claims, which is one reason early legal advice matters when a government entity is involved.
